Terms of sale
1. Preamble
The company IOT Symphony, a simplified joint stock company (hereinafter "IOT Symphony"), registered in the Lille Trade and Companies Register, under the number 878 303 403, whose head office is located at 99A, boulevard Constantin Descat, 59200, TOURCOING, operating under the trade name "OCTAVIO" (hereinafter "Octavio"), offers for sale various products on its website www.octavio.fr (hereinafter "the Site").
The present general conditions of sale ("the General Conditions") aim to define the rights and obligations of Octavio towards any individual visiting or making a purchase on the Site (hereafter "the Customer").
The Customer is required to read these Terms and Conditions before placing an order. By registering on the Site and/or confirming the order of a product, the Customer declares that he/she accepts the Terms and Conditions without reservation. Octavio reserves the right to modify and update the General Conditions. Any order of a product on the Site or by any other means ("the Order") will be subject to the Terms and Conditions in effect at the time of the validation of such Order. These General Terms and Conditions of Sale are permanently accessible at the following address: www.octavio.fr/cgv in a computer format that allows them to be printed and/or downloaded, so that the Customer may proceed with their validation.
2. Products and conformity
The products offered for sale on the Site are presented with a description. The products comply with the standards applicable in France. The elements such as photographs, texts, graphics and all the characteristics illustrating and/or accompanying the products are not contractual, which the Client acknowledges. Consequently, IOT Symphony cannot be held responsible in case of error or omission of one of these elements or in case of modifications of these elements.
Some products or services may only be available online on the Site. Some products may have limited quantities. IOT Symphony strives to display the colors and images of the Products as accurately as possible and cannot guarantee that the color displayed by the Customer's screen will be accurate. IOT Symphony reserves the right to limit the quantities of Products offered and to discontinue any purchase at any time. All Product descriptions or prices are subject to change without notice and at any time at the sole discretion of IOT Symphony. IOT Symphony does not guarantee that the quality of the Products purchased or obtained by the Customer will meet his/her expectations.
3. Order
Orders are validated only after payment has been accepted. IOT Symphony reserves the right to cancel or refuse an order in case of a dispute with the customer on a previous order. IOT Symphony can accept orders within the limits of available stocks. It informs the Client of the availability of the Products sold on the Site at the time of the order confirmation. If, despite the vigilance of IOT Symphony, the product is not available, IOT Symphony will inform the client by e-mail as soon as possible. The customer can then wait for the availability of the product if it is still in production or he can be reimbursed the amount already paid. IOT Symphony is not responsible for the permanent or temporary unavailability of the products and cannot claim any compensation or damages for the customer.
The order of products must not be intended for resale of any kind. IOT Symphony reserves the right to cancel any order made for this purpose and to refuse to supply the Customer in future orders. Any professional customer wishing to negotiate a "professional" or "business" rate must inform IOT Symphony before placing the order.
These same conditions also apply to pre-orders of products that may be offered by IOT Symphony (except for conditions specified in the "Pre-order" section).
4. Pre-orders
Pre-order periods may take place on an ad hoc and/or temporary basis, without prior notice and without a fixed deadline. In the case of a pre-order, the following conditions will prevail over the other points (in particular "Prices", "Payment", "Order" and "Delivery"). No time or date of delivery can be taken into account in an exhaustive way. The announced delays are only indicative and determined in an estimated way, so IOT Symphony cannot be responsible for the non-observance of these delays. IOT Symphony keeps the customer informed of the progress of the project and any delays on the estimated deadlines. Deliveries of pre-orders will be made in order of priority of purchase by the Customer. IOT Symphony reserves the right to offer a discount code (or apply a discount) during a pre-order period. This code, created for this purpose only, will not be applied once the pre-order period has ended. Apart from the above changes, the other conditions remain valid and binding.
The placing of a pre-order implies the acceptance by the customer of these GTC.
5. Prices :
The prices displayed on the Site are indicated in euros including all French taxes (French VAT and other taxes that may be applicable), excluding shipping costs and promotional codes.
The prices indicated do not include the shipping costs, called "Delivery". Delivery costs will be indicated in the Customer's basket, before the final validation of the order. Our delivery policy is available on the page " Delivery and Return " of the website: https://www.octavio.fr/livraison-et-retour. IOT Symphony reserves the right to modify its delivery policy at any time and without notice.
Any promotional code, issued exceptionally and punctually by IOT Symphony, must be inserted before the final validation of the order.
Prices of IOT Symphony products are subject to change without notice. IOT Symphony reserves the right, at any time, to modify or discontinue the service (or any part thereof) without notice. IOT Symphony cannot be held responsible to third parties for changes in pricing, suspension or termination of the service.
IOT Symphony can offer a "professional" rate to any professional customer wishing to equip his premises or installer of audio or home automation equipment. IOT Symphony reserves the right to refuse the negotiation of a "professional" rate without engaging the responsibility of IOT Symphony, nor can it open any right to compensation or damages in favor of the "professional" customer.
6. Client's obligations
The Client declares to be at least 18 years old and to have the legal capacity or to be the holder of a parental authorization allowing him/her to place an order on the website. The Client agrees to provide IOT Symphony with the real information necessary to carry out the service that is the object of the present general conditions of sale as requested online and according to his situation, including his name, first name, address, telephone and valid e-mail. The Customer is responsible for the consequences of false, inaccurate, erroneous or illegal information transmitted. Once the order is placed, IOT Symphony sends an e-mail to the Client confirming the order. IOT Symphony informs the Client when the products are shipped. The Customer can modify his data in the "my account" section.
7. Payment
The totality of the payment must be realized at the time of the order. At no time can the amounts paid be considered as deposits or down payments. The Customer pays for his order by credit card (Visa, Mastercard, American Express), with his PayPal account or via Apple Pay in accordance with the provisions of this article. For any transaction, the Customer will indicate the number on the front of his card, the expiration date of his card and the cryptogram on the back of his card (last three digits). The communication by the Client of his credit card number gives IOT Symphony the authorization to debit his account for the amount of his order. No cash on delivery will be accepted, whatever the reason. IOT Symphony keeps the property of the product until the full payment of the price by the customer. Purchases are made in a secure manner, the payment solutions offered by IOT Symphony are 100% secure. For credit card payments, all information that customers provide to IOT Symphony is strictly protected and guarantees the compliance and security of each transaction.
8. Delivery
The delivery policy proposed by IOT Symphony is detailed on the page " Delivery and Return " of the website: https://www.octavio.fr/livraison-et-retour.
IOT Symphony reserves the right to modify its delivery policy at any time and without notice.
Products ordered on the Site are prepared by IOT Symphony, several shipments are possible.
Products are shipped to the delivery address indicated by the customer when ordering. The address indicated must be able to receive packages. The delivery times indicated on the site are indicative, corresponding to the average processing and delivery times. In order for these delays to be respected, the customer must ensure that he/she has communicated exact and complete information concerning the delivery address (such as: street number, building number, staircase number, access codes, names and/or intercom numbers, e-mail, telephone number, etc).
IOT Symphony commits to informing the customer of the progress of his order. In case of damaged packages (already opened, missing products, etc.), the customer agrees to notify the carrier and IOT Symphony, by any means, any reservations within 3 days of receipt of the product.
IOT Symphony cannot be held responsible for the consequences of a delay in delivery that is not of its making.
IOT Symphony reserves the right to offer delivery fees on specific and punctual periods. Outside of the period specified at the time of the order on the website, the customer cannot ask for a waiver of the delivery fees.
9. Returns and refunds
The return and refund policy proposed by IOT Symphony is detailed on the page " Delivery and Return " of the website: https://www.octavio.fr/livraison-et-retour.
Right of withdrawal: The customer may withdraw within 30 (thirty) days from the date of receipt of the order. After this period, IOT Symphony will be unable to proceed with a refund or an exchange of the product.
For any refund, the customer must contact IOT Symphony's customer service and connect to an online portal. The return of the product(s) is at the customer's risk. The product must be returned in its original packaging and in its original condition. The return is at the Customer's risk. The return is at the customer's expense. Transaction fees (in the case of a payment by PayPal) may be deducted from the total amount of the refund.
Once your return is received and accepted, a refund, credit note or exchange will be initiated depending on your choice. Refunds may take up to 14 days.
IOT Symphony reserves the right to change its return and refund policy at any time without notice.
10. Intellectual property
Under no circumstances is the Customer allowed to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos...). This site or any part of this site may not be copied, reproduced, sold or exploited for commercial purposes without the written permission of IOT Symphony.
In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site and on the Products will remain the entire property of IOT Symphony.
The Client is therefore bound to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products, or register any trademark that would be prejudicial to the owner of the rights, unless otherwise stipulated in the contract. The same applies to any other intellectual property right.
11. Personal data
IOT Symphony's policy in terms of Personal Data is detailed on the page: " Privacy Policy ": www.octavio.fr/privacy-policy.
IOT Symphony is committed to using the confidential information of its clients only in the context of the operation of its website. For the proper processing of the order, the personal data collected are subject to computer processing, the customer acknowledges having knowledge. For this reason, the information concerning the client may be transmitted and communicated to technical service providers and partners of IOT Symphony. IOT Symphony may use technical means to obtain non-personal information about Internet users in order to improve the functionality of the site, for example by tracking the number of visitors to certain pages.
In accordance with the law of January 6, 1978 modified by the law of August 6, 2004, the client has the right to access and rectify personal data concerning him/her in IOT Symphony's files. Any request must be sent by e-mail to the address: contact@octavio.fr.
